1. Definitions

• "Platform" refers to the KrishiNex mobile application and website.
• "NexCard" refers to the proprietary smart membership and financial card issued by KrishiNex.
• "KSP" (KrishiNex Sewa Point) refers to our authorized retail and service franchise partners.
• "User" refers to any individual, primarily farmers, accessing the app for agricultural or financial services.

2. Account Registration and KYC

• 2.1 Eligibility: You must be a citizen of India and at least 18 years old to register an account and apply for a NexCard.
• 2.2 True Information: You agree to provide accurate, current, and complete information during the registration process, including valid phone numbers and farm details.
• 2.3 KYC Compliance: To access financial features, subsidies, or the NexCard, you must complete the mandatory Know Your Customer (KYC) process by submitting valid government-issued IDs (such as Aadhaar Card or PAN Card).
• 2.4 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials, PIN, and One-Time Passwords (OTPs). KrishiNex will never call or message you asking for your PIN or OTP.

3. NexCard Usage and Subscriptions

• 3.1 Issuance: The NexCard is issued exclusively by Knexis Technologies Pvt. Ltd. and remains the property of the Company. It is strictly non-transferable.
• 3.2 Subscription Fee: Access to premium NexCard benefits requires an annual subscription fee. This fee is non-refundable once the card is activated.
• 3.3 Financial Services: The NexCard facilitates 24x7 cash withdrawals, agri-finance options, and direct subsidy transfers solely at authorized KSP centers or designated partner ATMs.
• 3.4 Loss or Theft: In the event of loss, theft, or unauthorized use of your NexCard, you must immediately block the card via the KrishiNex app or call our toll-free helpline. The Company is not liable for any financial loss incurred before the card is reported lost.

4. KrishiNex Sewa Points (KSP) Network

• 4.1 Authorized Centers: Transactions, returns, and cash withdrawals are valid only at officially authorized KSP centers.
• 4.2 Franchise Agreements: Individuals operating KSP centers are bound by a separate "KSP Vendor Agreement." These Terms apply to their usage of the app in addition to their vendor agreements.
• 4.3 Service Availability: While we aim to provide continuous service, KrishiNex does not guarantee that all KSP centers will have 100% inventory or cash availability at all times.

5. Agri-Inputs, Drone Services, and Purchases

• 5.1 Product Quality: KrishiNex facilitates the sale of seeds, fertilizers, and farming equipment. While we partner with reputed brands, the respective manufacturers bear the ultimate liability for product efficacy.
• 5.2 Agriculture Drone as a Service (ADaaS): Drone spraying and mapping services booked through the app are subject to weather conditions, local airspace regulations, and pilot availability. KrishiNex reserves the right to reschedule drone services for safety reasons.
• 5.3 Pricing: All prices listed on the app are subject to change without prior notice. The final price, including applicable taxes, will be displayed at checkout.

6. User Conduct and Restrictions

You agree NOT to use the KrishiNex Platform to:

• Engage in any fraudulent, unlawful, or money-laundering activities.
• Attempt to hack, reverse-engineer, or disrupt the platform's servers or networks.
• Submit false documentation or impersonate another individual.
• Use the platform for any purpose other than bona fide agricultural and allied financial activities.

7. Intellectual Property Rights

• All content, logos (including the KrishiNex and NexCard logos), designs, software, and trademarks displayed on the platform are the exclusive intellectual property of Knexis Technologies Pvt. Ltd.
• Users are granted a limited, non-exclusive license to use the app for personal, agricultural business purposes. Unauthorized copying or commercial distribution of our intellectual property is strictly prohibited.

8. Limitation of Liability

• To the maximum extent permitted by Indian law, Knexis Technologies Pvt. Ltd., its founders, directors, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from crop failure, weather conditions, or the use/inability to use our financial and drone services.
• Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the specific product, service, or subscription in dispute.

9. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using KrishiNex, you consent to the collection, use, and sharing of your data (including KYC data) with our banking and franchise partners strictly for the purpose of fulfilling your requested services.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account, block your NexCard, and initiate legal action without prior notice if we detect a breach of these Terms, suspicious financial transactions, or abusive behavior toward KSP partners or KrishiNex staff.

11. Modifications to the Terms

KrishiNex reserves the right to update or modify these Terms at any time. Significant changes will be communicated via app notifications or SMS. Continued use of the platform after modifications constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any disputes arising out of or in connection with these Terms, the NexCard, or KrishiNex services shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India.
